(“the website”), operated by Emily Brown, FDOM, (Focus Declutter Organise Manage) (“I”, “me”, “our”, “we” or “my”).

By accessing or using our Website and any of our other Services, Memberships or Products in any manner, including, but not limited to, visiting, browsing, contributing content (or other materials), viewing, downloading and utilising any of our Products or Services, you agree to be bound by these Terms and Conditions and our Privacy Policy. Capitalized terms are defined in this Agreement.


1. INTELLECTUAL PROPERTY

The Website and its original content, features and functionality are owned by Emily Brown, FDOM and are protected by copyright and other intellectual property or proprietary rights laws.
You will be provided with original content, downloadable information and other materials, courses, videos and other tools, support or advice from FDOM.

At all times the intellectual property rights and copyrights connected with all materials remain with FDOM.


You have the right to use the materials as personal learning tools but you are not permitted to duplicate, republish, reproduce, distribute, translate or provide copies to any third parties. We retain and reserve all of our copyrights.


2. REFUND POLICY

You will be covered by the 14 day cooling off period after purchasing any downloadable Product from FDOM. During this time, you have a right to cancel the purchase and receive a refund if you have not accessed the content by completing the download.

If you have completed the download (and therefore accessed the content), you will no longer have protection of the 14 day cooling off period.

You will not be entitled to a refund after 14 days.


3. PRIVACY AND CONFIDENTIALITY

By providing your personal data you agree to the terms of our Privacy Policy.

During membership of our Group (or groups), you may have access to confidential information, in particular the personal affairs of other group members.
In accepting these Terms, you agree that you will not use or disclose to any person, organisation or company, and shall use your best endeavours to prevent the publication of, any confidential information relating to any other member.

You accept that any unauthorised disclosure of personal or confidential information belonging to another may amount to immediate dismissal from the group. Should you decide to leave the group then you remain bound by the confidentiality and privacy obligations.

Please be aware that some live training sessions or meetings may be recorded and your name and image/video may be captured.

The recordings of the training will be kept and may be made available to others.

If you provide or share any information within these sessions about yourself that information may be shared.

Should you not wish to be recorded please ensure that if you attend any training your camera is switched off and your name field is changed to “Anonymous” so that no identifiable information will be captured.


Your personal log-in details must remain confidential and you must not disclose or transfer this information to a third party without our express permission in writing.
If you know, or suspect that your log-in details have been compromised, you agree to change your password immediately and notify us as soon as possible at: [email protected]


4. NON-COMPETE

You agree that whilst in our Groups, Membership or using any other Service provided by FDOM and following termination or cancellation of the same, you shall not use any information or resources, including any confidential information revealed to you, for any commercial purpose.
In addition, you shall not elicit or entice away any current or potential members by sending personal messages or otherwise contacting them for this purpose. You also agree not to become involved in any capacity with any business concern which is in or appears to be in direct competition with FDOM.


5. WAIVER

In the event that we fail to insist upon your strict performance of any obligations under these Terms or we fail to exercise any rights or remedies to which we are entitled, this will not constitute a waiver of any such rights and/or remedies or action available to us in the future.


6. ERRORS OR INACCURATE INFORMATION

There may be information within our Website, Groups, Pages, Products or Memberships which contains typographical errors, inaccuracies or omissions relating to the service delivery, pricing or promotion of our products or services. We reserve the right to correct or amend any errors without prior notice.


7. LINKS TO OTHER SITES

The Website, Page or Groups may contain links to third-party sites that are not owned or controlled by Emily Brown. Some of the links on this Site may be ads, partners or affiliates. This means I may make a small commission if you buy from the linked sites. I only link to products and services that I am familiar with and those that I would be happy to use myself.

Emily Brown and https://www.fdom./co.uk have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party websites that you visit.

8. GOVERNING LAW

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of the United Kingdom without giving effect to any principles of conflicts of law.


9. CHANGES TO THIS AGREEMENT

We reserve the right to modify or replace these Terms and Conditions by posting the updated terms on the website. Your continued use after any such changes constitutes your acceptance of the new Terms and Conditions. Please review this Agreement periodically for changes. If you do not agree to any of this Agreement, please do not access or use the website or discontinue use immediately.

10. TERMINATION

We may terminate your access to the Website, Page or Groups without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. It is recommended that any item purchased is downloaded to your own device to ensure it is accessible to you.

11. DISCLAIMERS

We make no guarantees as to the success of any of our Service Users, Members or Clients when accessing our services.

Each individual will be responsible for their own learning and implementation of the information in our Groups or Memberships or when utilising our Products, advice or support and the level of success will depend on their own interpretation and implementation.

Any training provided will be general information and guidance and is not bespoke advice (unless otherwise clearly stated at the time).
We are not responsible for any action or inaction which you take as a result of the information provided by FDOM.

We ask that all Members and users of our Services, Memberships and Groups, respect the rights of others in respect of their behaviour and privacy.

We will not be responsible for the action or inaction of any members, including any disclosures made by any members based on information which has been shared in our Groups or Memberships.

We are not responsible for any loss of opportunity or any investments which you make.

No content from FDOM should be construed as medical advice, whether mental or physical. If you believe that you require medical attention, you should seek assistance from a medical professional immediately.

12. LIMITATION OF LIABILITY AND INDEMNIFICATION

To the fullest extent permitted by applicable laws, we limit liability and responsibility for any harm resulting from your use of all or any part of our Products, Services, Memberships or Groups.

We shall not be liable to you for any damages, including lost profits, whether such claim is based on warranty, contract, tort or otherwise (even if we have been advised in advance of the possibility of such damages).If we are found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of our services, our liability shall in no event exceed the total of any fees paid with respect to the Products or Services received by us from you, during the 6 months preceding the date on which the claim arose.

Nothing in these Terms shall limit or exclude our liability in respect to fraudulent misrepresentation, death, or personal injury resulting from our negligence or any other liability which cannot be limited or excluded by law.

You agree to indemnify, defend and hold us, our subcontractors and employees, harmless from any claim or demand, including solicitors’ fees, made by a third party due to or arising out of your breach of these terms or your violation of any law or the rights of a third party.

13. COMPLAINTS

It is our aim that you are completely satisfied with the information, support, Services and Products that FDOM provides.

14. GENERAL

We intend to rely on the written Terms set out in Terms and Conditions for the services that we provide to you.

These written Terms shall constitute the entire agreement between us.Should there be any conflict between these Terms and those of any other platform or payment gateway used, these Terms shall prevail.

If any provision within these Terms is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect (unless that would contradict the clear intention of the parties, in which case the entirety of the relevant provision will be deemed to be deleted).
